FREQUENTLY ASKED QUESTIONS

Conveyancing Explained

What is conveyancing and why do I need a conveyancer when buying or selling property?

Conveyancing is the legal process of transferring ownership of property from one party to another. A conveyancer or solicitor ensures contracts are reviewed, legal requirements are met, searches are completed and settlement occurs correctly. This helps protect your interests and reduces the risk of costly mistakes.

How long does the conveyancing process usually take?

In Queensland, conveyancing typically takes around 30 to 90 days from contract signing to settlement, depending on the terms of the contract and whether any issues arise. Each transaction is different and our team will keep you informed at every stage.

What is electronic settlement (PEXA) and how does it help me?

PEXA is Australia’s national electronic settlement platform. It allows property settlements and lodgements to be completed securely online. Using PEXA helps reduce delays, improves accuracy and ensures funds and documents are exchanged simultaneously at settlement.

Can Kingdom Lawyers help with interstate property transactions?

No, our professional team is trained in assisting clients with buying or selling property across Queensland only. Our focus on Queensland property gives us an edge with systems optimised to meet your Queensland property needs. We manage the Queensland aspects of your transaction and work with interstate professionals for other deals where required.

I’m interested in a property, what now?

Before signing a contract, it is important to obtain legal advice. We can review the contract, explain key terms, advise on conditions (such as finance, building, pest clauses and special conditions) and help you understand your rights before you commit.

What do I need to do to verify my identity?

Verification of identity is a legal requirement for property transactions in Australia. You will need to provide original identification documents, such as a passport or driver’s licence. We will explain the process and help ensure it is completed correctly.

Do I have to provide a smoke alarm compliance certificate?

In Queensland, sellers must ensure smoke alarms comply with current legislation at the time of sale. A smoke alarm compliance certificate or declaration is commonly required. Our legal team can advise you on your obligations based on your property and transaction.

Do I have to provide a pool safety certificate?

If a property has a pool, Queensland law requires a valid pool safety certificate before settlement, unless an exemption applies. We will confirm whether this applies to your property and guide you through the process.

What is a Seller’s Disclosure Statement (Form 2)?

The Seller’s Disclosure Statement (Form 2) is a document required under Queensland law that provides buyers with important information about the property. It must be given to the buyer before signing the contract. Errors or omissions can have serious consequences, so it’s best to contact our team to advise you accordingly.

Do I pay your fees now or at settlement?

For most conveyancing matters, our professional fees are paid at settlement, with certain outlays payable as they arise. We will clearly explain the timing of all costs before we proceed.

How do you keep my money safe?

At Kingdom Lawyers, we follow industry standard cyber security protocols to ensure your funds stay where they belong. All client funds are held in a regulated trust account in accordance with Queensland law. These accounts are strictly controlled and audited to ensure your money is protected at all times.
